Our Terms and Conditions of Supply and Fitting
Goods are ruled by the requirements of the Consumer Rights Act (CRA) 2015, The Child Safety requirements BS EN 13120:2009+A1:2014, and The Alternative Dispute Resolution for Consumer Disputes Regulations 2015.
CONTRACT
If you place an order on our website, through a catalogue, or by telephone, the contract will only be made when we send a letter or email confirming we have accepted your order. If you place an order with one of our salespeople (either at our premises or elsewhere), the contract will be made when you sign the order form or reply to our confirmation email.
GOODS
The goods you receive from us must be of satisfactory quality, fit for common purpose or any purpose made known to us, and must meet any description given. Please note that the images of the products we supply in our sales literature or online are for illustration purposes only, and we cannot guarantee that these printed/computer-displayed images will reflect the colour of the goods accurately. Our packaging may also vary.
SERVICES
If we agree to carry out a service for you, we will ensure that this is carried out using reasonable care and skill.
GUARANTEE
- One-Year Manufacturer Warranty: Most goods/services come with a standard one-year warranty from the manufacturer.
- Shutters Warranty: Shutters have a more extended warranty period of 5 years.
CHILD SAFETY
If the goods contain any safety device(s) and/or are to be fitted in accordance with child safety requirements placing an obligation on all businesses to supply and professionally install safe products, then we will be required to fit such device(s). If you instruct us that you do not wish to have the safety device(s) fitted, we will refuse to install the goods. In such an instance, you will still be liable to pay up to the full price.
MEASUREMENTS
If you are providing your own measurements, ensure they are correct and accurate, as we cannot accept the return of made-to-measure goods on the basis that the measurements were incorrectly supplied by you.
INSTALLATION
The price for installation was agreed on the assumptions that:
- There will be one continuous site visit.
- There is unobstructed access to outside your property for vehicle parking.
- The area where the goods are to be fitted is unobstructed.
- Surfaces and grounds where the goods are to be fixed are in good condition, allowing us to obtain good fixings easily.
- There are no objects in the immediate working area.
- There is no asbestos that we would likely come into contact with.
- No items under warranties/guarantees will be invalidated by the installation.
We may charge additional fees if these conditions are not met. We are not responsible for any unforeseeable loss or damage to your property, costs of repairing pre-existing faults, or damage discovered during installation.
ACCESS
If you do not allow us access to the premises as agreed, we may charge reasonable additional costs. If we cannot contact you to rearrange access, we may end the contract, and you will still be liable for payment.
PRICE
The price for goods/services is detailed in the order form and includes VAT. Payments are due as outlined in the order form. Deposits paid will be deducted from the final payment, which is due upon dispatch or installation.
FURTHER CHARGES
Additional charges may apply in unforeseen circumstances, and late payments may incur interest at 8.95% above the AIB base rate, accruing daily.
DELIVERY
Delivery and installation costs are included in the price unless stated otherwise. If no one is available at the delivery address, we will leave a note for rearrangement. Additional storage or delivery costs may apply if arrangements are not made promptly.
DELAY OUTSIDE OUR CONTROL
If delays occur due to circumstances outside our control, we will inform you and minimize the delay. We are not liable for such delays if goods are delivered within a reasonable time.
YOUR RIGHT TO CANCEL
You may cancel a contract if:
- There is a pricing or description error you were informed of.
- There is a risk of significant supply delay.
- You have a legal right to cancel due to our breach.
OUR RIGHT TO CANCEL
We may end the contract if payment is overdue, access is denied, or an obvious pricing error occurs.
LIABILITY
We are responsible for foreseeable loss or damage caused by breaching the contract or negligence.
THIRD PARTIES
The contract is between you and us. No third party has rights to enforce its terms.
COMPLAINTS
Inspect goods and installation work promptly and report issues to us. Complaints not resolved to your satisfaction may be referred to the British Blind and Shutter Association or other appropriate dispute resolution providers.
OWNERSHIP AND RESPONSIBILITY FOR GOODS
Goods become your property upon full payment and your responsibility from the time of delivery, collection, or transfer to a third party organized by you.
LEGALITY
The contract is governed by Irish law.
